These terms govern the use of the synthetic monitoring service published by Dimitri Allegoet Consulting at https://synthetic-monitoring.com (the "Service"). Creating an account means accepting them.
Professional use only
The Service is offered to professionals acting for the purposes of their trade, business or profession. It is not offered to consumers, and the provisions of the French Consumer Code on distance selling to consumers, including the fourteen-day withdrawal period, do not apply.
The Service
The Service runs the Playwright scripts you provide, on the schedule you set, from the regions we offer. It records the result of each run, keeps its artifacts for the retention period of your plan, and notifies the alert channels you configured when a monitor fails.
Your account
You are responsible for the accuracy of the information you give us, for the confidentiality of your credentials, and for everything done through your account. Each account receives a personal workspace; you may invite members and grant them roles.
Plans and billing
The Free plan is available without payment and carries the limits shown on our pricing page. Paid plans are billed monthly in advance through Stripe, our payment provider; we never see or store your card details.
Prices are in euros and exclusive of tax. Subscriptions renew automatically until cancelled. You may cancel at any time from the billing portal; the cancellation takes effect at the end of the current period, and the workspace returns to the Free plan. Amounts already paid are not refunded for a period that has started.
What you may run
You warrant that you are entitled to run your scripts against the sites they target, either because you operate those sites or because their operator has authorised you. You must not use the Service to attack, overload, or gain unauthorised access to any system, to circumvent an access control, or to break any law.
You remain responsible for the content of your scripts, including any credential or personal data they handle. We may suspend a monitor, or an account, that breaches this section, and will tell you why.
Availability
We do our best to keep the Service available and to run your monitors on time, but we do not guarantee uninterrupted operation. Runs may be delayed or skipped during maintenance, during an incident at one of our providers, or when a plan limit is reached. The Service is a monitoring tool: it does not guarantee the availability of the sites you monitor.
Intellectual property
We keep all rights in the Service. You keep all rights in your scripts and your data; you grant us the licence needed to store and run them in order to provide the Service.
Liability
Our liability towards you, for any cause, is capped at the amounts you paid over the twelve months preceding the event. We are not liable for indirect damage, in particular loss of turnover, loss of customers or loss of data held elsewhere.
Nothing in these terms excludes liability that the law does not allow us to exclude.
Termination
You may stop using the Service and delete your account at any time from your account page. We may terminate your account for a breach of these terms, after notice by email, except where the breach makes immediate termination necessary.
Changes
We may change these terms. Material changes are announced by email at least thirty days before they take effect; continuing to use the Service after that date means accepting them.
Governing law
These terms are governed by French law. Any dispute that cannot be settled amicably falls under the exclusive jurisdiction of the courts of Lyon, France.
